12 Days of Trademark Wishes
Sharon Griffin

As the days are growing shorter and colder here in the northern hemisphere, we are beginning preparations for our holidays.  As our thoughts turn to gift ideas for our friends, family, and coworkers, we have thought of a few presents for our trademark clients.

Dear Clients, here are our holiday trademark wishes for you:

1.  May your royalty rates for your trademark licenses be in the high double digits.

2.  May you have completely clear worldwide trademark and domain name search results for your proposed brands.

3.  May you never have to be cross examined.

4.  May you, and yours, never forget a deadline or docket something incorrectly.

5.  May you never have a transfer pricing tax issue with the Canada Customs and Revenue Agency (CCRA) or the Internal Revenue Service (IRS).

6.  May all of your licensees follow your license agreements to the letter.

7.  May you have clean chains of title, all properly and thoroughly documented, for your entire trademark portfolio – including for all related copyrights for your design trademarks.

8.  May you never have to indemnify anyone.

9.  May the trademark offices of the world agree with all of your arguments in office actions for the prosecution of your trademarks.

10.  May your corporate veils remain intact.

11.  May you have proper use, and supporting evidence, of all of your wares and services.

12.  May all of your oppositions and trademark expungement proceedings against competitors’ trademarks succeed.

Have a happy, and healthy, holiday and New Year!
