Harvesting and Leveraging your R&D

Canada offers one of the most generous tax incentive programs worldwide. The Federal Scientific Research and Experimental Development (SR&ED) tax credit program is intended to increase Canadian competitiveness in the world marketplace and to stimulate domestic growth.

The patent regime is likewise intended to promote innovation and provide a market-oriented stimulus for research and development activities. In addition, the process of obtaining legally enforceable intellectual property rights is in many ways similar to the process of obtaining SR&ED tax incentives. Leveraging these similarities is an important tool in maximizing benefit from research and development activities.

SR&ED Key Benefits:
• A tax credit as high as 35% refundable for qualifying Canadian Controlled Private Corporations – or 20% on qualifying expenditures.
• Immediate deductions for all eligible R&D related labour, material, capital and 65% proxy for overhead costs.
• Additional refundable provincial tax credits for qualifying corporation

Kent Smith is the senior manager responsible for the Ottawa SR&ED practice at PricewaterhouseCoopers. Kent has fourteen years of public accounting experience where he has enjoyed a progressive career focusing his practice of tax on the complexities of the SR&ED program. Prior to joining PricewaterhouseCoopers, Kent worked for a number of organizations where he developed a deep technical knowledge of the SR&ED legislation as well as extensive experience interfacing with tax authorities and working with companies of all sizes in the preparation of their SR&ED claims. In recent years, Kent has had significant involvement in some of the largest and most complex technology and manufacturing claims filed across the country.

Randall Marusyk is the managing partner of MBM Intellectual Property Law and has been certified as a specialist in all areas of Canadian Intellectual Property Law (Patent/Trademark/Copyright) by the Law Society of Upper Canada. Randall specializes in designing strategic intellectual property portfolios in light of clients’ business and marketplace needs. He has extensive experience in drafting and prosecuting a variety of patent applications before the Canadian and United States Patent Offices as well as coordinating their prosecution worldwide.

Alistair Forster is a lawyer, engineer, and member of MBM’s engineering patent prosecution team. He is involved with a number of diverse legal issues relating to patents, including inventorship, ownership, and formalities issues. His practice encompasses patent portfolio coordination, patent drafting and prosecution, and due diligence in a broad range of technologies including computer hardware and software, chemical, electrical, and mechanical applications. Prior to beginning his law practice, Alistair worked for a number of years as a chemical engineer.

Malcolm Williamson is Vice President, Business Development for Acorn Partners. He is responsible for development of new business including its current expansion across Canada. Malcolm was an entrepreneur involved in buy-outs and start-ups in Canada and the US, a former executive with F1000 and private companies, a business consultant for 11 years and a commercial banker. He has been a consultant to NAFTA and the Trade Association of the Americas. He is the catalyst behind the recently formed Canadian SR&ED Association.
