Dr. Elaine Johnson
Elaine Johnson practices
predominantly in the area of biopharma patent law, focusing on
prosecuting chemical and biopharma patent applications. She
has substantial experience in counselling clients on patent
validity, infringement, protest and strategy matters. Elaine
has a successful working rapport with many of the Canadian
Patent Examiners and has conducted numerous Examiner
interviews. She represents pharmaceutical and biotechnology
companies, both large and small, and is particularly
experienced in representing clients in domestic and foreign
patent prosecution.
Recent subject matter
Elaine has been involved with includes molecular biology,
retroviral vectors, antibodies and immunotherapy, membrane
receptors, diagnostic assays, medical treatments including
gene therapy, pharmaceuticals and drug delivery systems,
combinatorial chemistry systems, chemical compounds, analogs
and protected intermediates, organic synthetic processes,
surfactants, coatings and encapsulation technologies.
Prior to joining MBM,
Elaine was employed in the pharmaceutical industry where she
gained practical experience in cell culture and toxicology.
Her career has also included shepherding new drugs and devices
through Phase I to IV clinical trials, as well as experience
in establishing and maintaining GLP and GCP. Elaine has
further experience working within a business development
group, having responsibility for the development of new
product lines. Additionally, she gained experience working
within a Regulatory Affairs Department, where she assisted in
obtaining regulatory approval of health care products, and the
filing of FDA submissions.
Elaine is a member of the
firm's Notice of Compliance Practice Group, frequently
counselling clients on drug submission requirements for
listing a patent on the Canadian Patent Register. She
regularly advises clients on the specific requirements to
obtain registration and reimbursement in various different
jurisdictions, including Canada, Europe and the U.S.
