Jonathan Roch
Jonathan Roch’s work
includes the clearance, prosecution, acquisition, enforcement
and exploitation of patents, trademarks, copyright, industrial
designs, and other forms of intellectual property. He also
deals with trade secrets and domain name dispute resolution.
His practice is focused on
the drafting and prosecution of patent applications worldwide
in a broad range of technologies including medical devices,
environmental sciences and general mechanical inventions, and
the development and management of intellectual property
portfolios. He also has experience in drafting intellectual
property agreements.
Jonathan lectures at the
University of Ottawa on exceptions to exclusive rights
conferred by patents, the Patented Medicines Price Review
Board (PMPRB) and Canada’s Access to Medicines Regime as part
of a larger course on intellectual property law as it relates
to biotechnology and pharmaceuticals.
Jonathan's Masters studies
examined the latest national and international developments in
the fields of patents, design, software and databases,
integrated circuits, biotechnological patents and plant
varieties, trademarks, domain names, copyright and related
rights, as well as Internet and e-commerce. His Master's paper
entitled "Rethinking Canada’s Experimental Use Exception to
Patent Infringement" explored the policy reasons that favour
and discourage experimental use exceptions, Canada’s patent
policy framework, Canada’s international obligations and
global approaches to research or experimental uses of patents
in order to determine the scope that should be given to a
general experimental use exemption in Canada.
