Compliance (NOC) Practice Group
MBM's Notice of Compliance
(NOC) Practice Group was a natural development arising from
MBM's pre-existing Food and Drug Regulatory, Patent Drafting &
Prosecution, and Litigation practices.
Our clients, that
originally came to MBM for the drafting and prosecution of
their pharmaceutical patents, wanted to take advantage of
Canada's Patented Medicines (Notice of Compliance) Regulations. MBM developed a specialty of drafting and prosecuting
pharmaceutical patents to ensure the highest likelihood of
securing a patent claim eligible for listing on Health
Canada's Patent List.
This initial expertise led
to the development of other NOC related services, including:
strategies and advocacy related to the complaint process with
Health Canada's Office of Patented Medicines & Liaison,
judicial reviews of government decisions to refuse a patent
for listing, or for de-listing a patent; strategy and opinions
regarding the regulatory approval of drugs, medical devices,
and natural health products; strategy and opinions regarding
data protection/exclusivity; and legal strategy and advice
regarding issues related to the Patented Medicine Prices
Review Board in Canada.
Of the 12 members of MBM's
NOC Practice Group, 3 of the founding members are former
employees of Health Canada, 6 have a Ph.D. in the health
sciences, 8 are patent agents, 6 are lawyers, and 2 are former
employees of major pharmaceutical companies. This
multidisciplinary group works closely together to ensure that
our client's current needs are met, and that future needs are
anticipated.
