Trade-mark FAQs

How Much Will It Cost?

You have a creative name, logo or tagline. It represents the face and the ideas of your company in the market and as such, in the market it has value, or "brand equity." Depending on your business, brand equity can be worth millions; even billions of dollars. You need to protect that equity and your niche in the market. Similar to patents, trade-marks are business tools. You file for and/or purchase trade-marks to build your business strategically and to enhance the value of your company.

Our trade-mark filing service includes a comprehensive and methodical analysis of your wares and services, as well as other trade-marks in your market space. We tailor a trade-mark strategy to suit your present and future goals. It can be conservative or aggressive, depending upon your business objectives and the markets that you are targeting. Strategic business thinking is applied at every stage, ensuring that your trade-mark is as effective as it can be in supporting your business objectives.

Trade-mark Search

If you consider your name or logo to be capable of registration, a trade-mark search should be conducted to assess the registrability and the availability of your proposed mark. This search will help identify any possible impediments to the registration of your proposed mark as well as any potential disputes that may arise in the future.

Trade-mark Application Process

The trade-mark application requires information about the applicant, a description of the goods and/or services associated with the mark, a graphic representation of the mark (if applicable), a statement that you are using the trade-mark, or you intend to use the trade-mark in Canada, and payment of the applicable government fees.

Once the application is accepted, it is advertised in the Trade-marks Journal, and provided that the application is not opposed, the trade-mark application will proceed to allowance. Once use of the trade-mark has commenced and the prescribed government fee has been paid, a Certificate of Registration will be issued.
